Veteran musician Ilaiyaraaja recently took a major legal action. He filed a lawsuit against the producers of the film Dude and three major music companies—Sony Music Entertainment India Pvt. Ltd., Echo Recording Company, and Oriental Records. Ilaiyaraaja alleges that two of his songs have been used in the film without permission. He filed a petition in court alleging a violation of his copyright rights. Now, the Madras High Court has granted him permission to pursue the case, officially beginning the legal battle.
What did Madras High Court say on copyright controversy?
During the hearing on October 22, Justice N. Senthilkumar heard arguments from both sides. Senior advocate S. Prabhakaran, representing Ilaiyaraaja, informed the court that Sony had not yet filed its response, even though the songs were still being used in the film. Meanwhile, senior advocate Vijay Narayanan, representing Sony, stated that the company had submitted its income statements and would file a response soon. He also stated that the Supreme Court has ordered that a petition be filed to transfer over 500 music copyright cases pending across the country from the Bombay High Court to the Madras High Court.
Previously, the Madras High Court had directed Sony to submit to the court complete details of the commercial income generated from Ilaiyaraaja’s songs. However, Justice Senthilkumar has now returned Sony’s income statements, as the Supreme Court had previously ordered that this information not be made public. This ensures the confidentiality and protection of Ilaiyaraaja’s copyright rights. This decision symbolizes how seriously the court is concerned with the rights of musicians.
The next hearing in the case will be held on November 19th. The court has formally granted Ilaiyaraaja permission to file a lawsuit against the team of the film Dude. While the case is progressing slowly due to pending cases in the Supreme Court, this decision could have a major impact on music copyright disputes in Indian cinema. This legal battle between Ilaiyaraaja and Sony is not only an important step towards protecting the rights of a musician, but it can also become a precedent for the industry in the future.
